REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (MONTICELLO NUCLEAR GENERATING PLANT)

Dear Mr. Anderson:

By Northem States Power Company's (NSP's) application and affidavit executed by Michael F.

Hammer dated October 1,1998, NSP submitted its response to an NRC request for additional information on NSP's November 18,1997, request for deviation from the Boiling Water Reactor Owners' Group Emergency Procedures Guidelines, Revision 4 (NEDO-31331, March 1987) and requested that two flow charts (Attachments 3 and 4) be withheld from public disclosure pursuant to 10 CFR 2.790.

NSP stated that the two Emergency Operating Procedure (EOP) flow charts, "C.5-1100 RPV Control," Revision 5, and "C.5-1100 RPV Control," Revision 6, should be considered exempt from mandatory public disclosure for the following reasons-l Public disclosure of the information sought to be withheld is likely to cause harm to NSP's competitive position and reduce the availability of profit-making I

opportunities. The research, development, engineering, and analytical costs comprise a substantialinvestment of time and money by NSP. The value of this information to NSP would be lost if the information were disclosed to the public.

Making such information available to competitors without their having been l

required to undertake a similar expenditure of resources would unfairly provide l

competitors with a windfall, and deprive NSP of the opportunity to exercise its competitive advantage to seek an adequate retum on its investment in l

developing this information.

We have reviewed NSP's application and the material in accordance with the requiroments of 10 CFR 2.790 and, on the basis of NSP's statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be l

withheld from public disclosure.

Therefore, EOP flow charts "C.5-1100 RPV Control," Revision 5, and "C.5-1100 RPV Control,"

Revision 6, marked as proprietary and submitted as Attachments 3 and 4 to NSP's letter of October 1,1998, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
