RELIEF FROM FIRST 10-YEAR INSERVICE INSPECTION REQUIREMENTS Re: James A. FitzPatrick Nuclear Power Plant This is in response to your letter dated March 15, 1985 regarding the first 10-year-interval 1,nservice inspection program for the James A. F1tzPatrick Nuclear Power Plant. In your letter, you requested clarification and reevaluation of those requests for relief from certain examination requirements of Section XI of the ASME Boiler and Pressure Vessel Code, which were denied in our letter issued January 31, 1984.

We ha've reviewed the additional information you provided and have granted further relief on the basis that the examination requirements for which relief has been requested and approved are impractical, and pursuant to 10 CFR 50.55a(g)(6)(i), that the granting of this relief is authorized by law and will not endanger life or property or the common defense and security is otherwise in the public interest. In making this determination, we have given due consideration to the burden that could result if these requirements were imposed on your facility.

In addition, we have reviewed your letter dated March 4, 1985 wherein you proposed a modified inservice inspection program plan in which the inspection interval for Class 1, 2 and 3 components would be combined. We find this revision to be acceptable.
