SUBJECT: NRC INSPECTION REPORT 50-333/99-03 l

Sear Mr. Colomb:

On April 11,1999, the NRC completed an inspection at the James A. FitzPatrick Power Plant.

The enclosed report presents the results of that inspection.

During the six-week inspection period covered by this report, the facility was operated safely.

The root cause analysis performed following the January 1999 hydrogen fire represented an

excellent engineering analysis and a critical self evaluation. However, our findings during this

period indicate the need for increased awareness of technical specification requirements and ,

equipment operability because we observed two examples where your staff failed to question j

the status of equipment. In one of these cases, the inspectors discovered that both drywell

continuous atmosphere monitor subsystems were inoparable.

Based on the results of this inspection, the NRC has determined that four violations of NRC

requirements occurred. These violations are being treated as Non-Cited Violations (NCVs),

consistent with Appendix C of the Enforcement Policy. The NCVs involved: 1) not having a

sufficient number of operable safety relief valves during the last operating cycle,2) not meeting

main steam isolation valve (MSIV) leakage requirements during the last operating cycle, 3) not

performing a Technical Specification required surveillance, and 4) not maintaining proper

configuration control of the hydrogen addition system. The NCVs are described in the subject

inspection report, if you contest the violations or their severity level, you should provide a

response within 30 days of the date of this inspection report, with the basis for your denial, to the

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555-

0001, with copies to the Regional Administrator, Region I, and the Director, Office of

Enforcement, United States Nuclear Regulatory Commission, Washington, D.C. 20555-0001.
