SUBJECT: NRC INTEGRATED INSPECTlON 50-333/99-01

Dear Mr. Colomb:

On February 28,1999, the NRC completed an inspection at the James A. FitzPatrick Power

Plant. The enclosed report presents the results of that inspection.

During the seven week inspection period covered by this report, the James A. FitzPatrick

reactor facility was operated safely. In addition to routine operations, your staff appropriately

handled the operational challenges of a significant hydrogen fire in the hydrogen storage facility

and a minor electrical fire in a circulating water pump electrical junction box. . Specialist

inspections determined the security prograin, the solid radioactive waste and transportation

programs, and the operator work around program were effectively implemented. 4

The NRC identified that untimely corrective actions for the post scram control rod position

indication issue resulted from your staff's acceptance of an inadequate method of determining

control rod position. Your procedure, which allowed use of the non-conclusive indication of rod

position to verify that all rods were full-in following a reactor scram, was non-conservative and

could have allowed an incomplete reactor shutdown to occur.

Based on the results of this inspection, the NRC has determined that three violations of NRC

requirements occurred. These violations are being treated as Non-Cited Violations (NCVs),

consistent with Appendix C of the Enforcement Policy. These NCVs are described in the

subject inspection report. If you contest the violations or severity level of these NCVs, you

- should provide a response within 30 days of the date of this inspection report, with the basis for

your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk,
