On November 2,1998, the New York Power Authority (NYPA, also known as the Power Authority of the State of New York) submitted Revision 2 of the Third Interval Inservice Testing (IST) Program for Pumps and Valves for the James A. FitzPatrick Nuclear Power Plant. This submittalincluded two relief requests, which the NRC staff has reviewed against the i

requirements of Section XI of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code) pursuant to Section 50.55a of Part 50 to Title 10 of the Code of Federal Reaulations.

For Relief Request VRR-06R1, the NRC staff finds that compliance with the specific requirements of the ASME Code would result in hardsNp without a compensating increase in the level of quality and safety. Therefore, the proposed attemative described in Relief Request j

' VRR-06R1 is authorized pursuant to 10 CFR 50.55a(s)(3)(ii).

For Relief Request PRR-06, the staff finds that immediate compliance with the requirements

would result in a hardship without a compensating increase in the level of quality and safety.

However, in the long-term, the staff believes that it may be practical for NYPA to provide a means that could be used to fulfill the ASME Code requirements. Therefore, the proposed y

. attemative described in Relief Request PRR-06 is authorized for an interim period of 1 year v /8/

' from the date of this letter pursuant to 10 CFR 50.55a(a)(3)(ii). After that time, NYPA should either 1) resubmit this relief request with a more detailed description of how the human factors considerations preclude meeting the accuracy requirements of the ASME Code, and provide an indication of the differential pressure calculation accuracy that can reasonably be achieved with the installed system configuration, or 2) install instrumentation to directly measure the
