SUBJECT: NRC SPECIAL INSPECTION REPORT 50-333/99-02

Dear Mr. Colomb:

This letter transmits the results of a specialinspection conducted at the James A. FitzPatrick

Power Plant from January 25 to January 29,1999, and in the NRC Region I office from

February 1-5,1999. The inspection evaluated the results of your investigation into the causes of

the January 14,1999, hydrogen fire event and your response to the event. The results of that

inspection were discussed via telephone with you and other members of your staff on

February 9,1999.

Based on the results of this inspection, we determined that your overall response to the event

was acceptable. The operators' actions were prompt, the actions you took to extinguish the fire

were appropriate, and the subsequent event investigation was systematic and comprehensive.

We also noted good emergency planning response. In particular, the relocation and actuation of

the onsite emergency response facilities within an hour were noteworthy.'

During the event, the operators left the emergency diesel generators running unloaded and with

the tie circuit breaker open. Your staff later identified that this placed the plant emergency

electrical system in an unanalyzed condition. During our review of this issue, we determined

that there was minimal risk significance. However, operators and engineering staff did not fully

understand the operation and logic of the emergency diesel generator breakers.

Although a violation of NRC requirements, the fa!!ure to secure the emergency diesel generators

as required by the surveillance procedure is not being cited in Lccordance with the guidance of

Appendix C of the NRC Enforcement Policy. We believe reasonable actions were taken by your

staff to address the issue and prevent recurrence.

If you contest the violation or severity level of the NCV, you should provide a response within

30 days of the date of this inspection report, with the basis for your denal, to the Nuclear

Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001, with

copies to the Regional Administrator, Region I, and the Director, Office of Enforcement, United I
