By [[letter::JPN-88-063, Comment on Proposed Rule 10CFR26 Re Fitness for Duty Program.Util Has Constitutional Concerns Re Proposed Random Testing Which Should Be Fully Addressed Prior to Rule Being Promulgated.Endorses NUMARC & EEI Comments|letter dated November 18, 1988]], the staff forwarded the results of our review of your submittals concerning the Alternate Pod Insertion (ARI) and Recirculation Pump Trip (RPT) designs concerning the James A. FitzPatrick Nuclear Power Plant. The letter indicated that the design was not completely acceptable, but that the issues were not of significant safety significance that modifications to address these issues be completed prior to startup from the next (i.e., 1990) refueling outage. Three specific issues were described in the safety evaluation included with the letter, in order to coirply with the ATWS Rule, .it was recuested that you provide an ARI System with instrument components that are civerse from the reactor trip system, modify the RPT initiation logic, and provide logic testing features.

By letter dated April 23, 195 you provided the ATWS implementation status for the FitzPatrick plant whh... described the changes made during the 1990 refueling outage. The letter described changes to the RPT logic, including.

changes to allow logic testing while the reactor is at power. Since you have not provided the diverse Analog Transmitter Trip Units (ATTVs), the diversity 1 issue remains unresolved. However, because this issue is being resolved generically with the BWR Owners Group and will be addressed independently, it remains open but does not affect the at:tus of this evaluation for compliance 1 with the ATWS Rule, j

-2 The staff has evaluated your submittal and determined that the modified design conforms to the requirements of 10 CFR 50.62, and is, therefore, acceptable.

flowever, the staff requests that changes be submitted to Technical Specification Table 3.2-7, " Instrumentation That Initiates Recirculation Pump Trip" to reflect the RPT System logic change and that the Final Safety Analysis Report (FSAR)beupdatedasappropriate. The safety evaluation supporting this ,

conclusion is attached.

This action closes TAC No. 59095.
