OF ALTERNATIVE SNUBBER INSPECTION AND SAMPLING (TAC NO. MA0711)  !

Dear Mr. Knubel:

On January 26,1998, the New York Power Authority (NYPA, also known as the Power Authority of the State of New York) submitted the inservice inspection program and relief requests for the third 10-year interval for the James A. FitzPatrick Nuclear Power Plant. This letter addresses one of the relief requests in that submittal.

NYPA had requested authorization for use of snubber visualinspection intervals and sampling rates given in NRC Generic Letter 90-09 as an attemative to the of American Society of 4 Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, inservice l snubber visual examination requirements contained in ASME/ ANSI OMa-1987 Part 4, published  !

in 1988. Relief is requested from performing visualinspections of snubbers at 18-month intervals, and the associated schedule changes, as required by ASME/ ANSI OMa-1988 Part 4, Sections 2.3.2.2, Examination Schedules, and 2.3.2.3, Subsequent Examination Schedule Adjustment. The Code inspection intervalis incompatible with the current plant 24-month operating fuel cycle at FitzPatrick.

In the enclosed safety evaluation (SE), the NRC staff SE concludes that the licensee's proposed attemative for snubber examinations intervals and sampling rates provides an acceptable level of i quality and safety. Therefore, the proposed altemative is authorized, pursuant to i 10 CFR 50.55a(a)(3)(i).

The cover letter of NYPA's January 26,1998 submittal referred to a license amendment request dated November 26,1996, stating that the relief authorized in this letter was necessary since the amendment request had not yet been approved. However, this amendment, which was issued on June 30,1998, merely relocated snubber inspection requirements from the TS to licensee-controlled documents subject to the provisions of 10 CFR 50.59. This amendment in no way k' relieved NYPA of the obligation to comply with relevant ASME Code requirements, as required by 10 CFR 50.55a. Therefore, the staff finds that the January 26,1998, submittal does not accurately describe the regulatory requirements for this activity. This finding does not affect the technical merit of the relief request.
