Dear Mr. Knubel:

On August 7,1998, the New York Power Authority (NYPA, also known as the Power Authority of the State of New York), proposed attemative testing following a containment repair. NYPA requested relief from the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code, (ASME Code)Section XI, lWE-5221. The request was made pursuant to 10 CFR 55a(a)(3)(i).

The repair is planned to patch a temporary hatch which will be cut in the torus of the James A.

FitzPatrick Nuclear Power Plant during an upcoming refueling outage. NYPA plans to use this hatch to facilitate installation of new suction strainers for the emergency core cooling and reactor core isolation cooling systems. The proposed alternative testing involves performing a containment pressurization test to verify integrity of the temporary hatch repair. This testing consists of pressurizing the containment to a minimum of 45 psig and holding that pressure for a minimum of 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />, as opposed to the pneumatic leakage test required by IWE-5221.

As documented in the enclosed Safety Evaluation, the NRC staff has reviewed your submittal, and concludes that your attemative program provides an acceptable level of quality and safety, and is an acceptable attemative to the requirements stated in paragraph IWE-5221 of the ASME Code,Section XI. Therefore, pursuant to 10 CFR 50.55a(a)(3)(i), the attemative is authorized.
