Gentlemen:

' Subject: Inspection Report No. 50-333/89-03

This letter transmits the results of the routine inspection conducted by

Messrs. W. Schmidt and R. Plasse of this office on March 5 to April 18, 1989

at the' James A. FitzPatrick Nuclear Power Plant, Scriba, New York.

Mr. Schmidt discussed the inspection findings with you and other members of'

your staff at the conclusion of the inspection.

Based on the results of the inspection two violations were identified. The

first deals with your failure to make a required notification to the NRC

i Operations Center when it was determined that temperature control valves to

unit coolers-in areas containing safety related equipment would fail closed

on a loss of air and could jeopardize both emergency AC power divisions. The

second deals with failure to ensure that surveillance testing of the High

Pressure Coolant Injection System was performed in accordance with the assumed

tions. .You are required to respond to this letter and in doing so should

. follow the instructions in Appendix A.

We also note that failure to make required notifications per 10 CFR 50.72, and

failure to ensure that surveillance testing is adequate to demonstrate system

operability have been the subject of recent escalated enforcement action by

the NRC. Although we have not completed our evaluation'of your corrective

actions, we are particularly concerned that these deficiencies have not been

fully corrected to prevent recurrence. This indicates a potential lack of

understanding of the NRC. reporting requirements and inadequate followup

actions in response to those previous violations. You should be prepared to

discuss these issues in detail at the meeting between your staff and the NRC ,

on May 30, 1989 in the Region I office.

With regard to your January 20, 1989 response to the Notice of Deviation issued

with Inspection Report 8B-23, dealing with the lack of continuous monitoring of )

the emergency 115 KV offsite power sources, we note that you disagree with the

Deviation. We have concluded that the Deviation stands, and as this inspection

report points out, your actions to resolve the coordination difficulties with

Niagara Mohawk Power Corporation have not been effective. In your response

to this letter please inform us of the arrangements that have been made and

those additional actions you intend to take to ensure proper monitoring and

coordination of the status of the 115KV power supplies with Niagara Mohawk.

You should also be prepared to discuss this issue during the May 30 meeting in

the Region I office.

. The response directed by this letter is nct subject to'the clearance procedures

of the Office of Management and Budget as required by the Paperwork Reduction

Act of 1980, PL 96-511.
