This letter transmits the results of the routine inspection conducted by

Messrs. W. Schmidt and R.:Plasse of this office on April 19, 1989 through

June 3,1989. at the James A. FitzPatrick Nuclear Power Plant, Scriba, New -

. York. Mr. .Schmidt discussed the ' inspection ' findings.with you and other

members of your. staff at the conclusion of the inspection.

We appreciate your participation in the May 30 meeting in. Region I. .The

discussions were beneficial, allowing better understanding of technical a'nd:

managerial issues from the perspective of both our organizations. -Your-

efforts to address concerns raised during the meeting, and your..self assess-

. ment' activities will be monitored in future inspections as the Systematic 3

Assessment of. Licensee Performance (SALP) period draws to an end in

September, 1989.

Our review of the circumstances leading to the missed fire barrier penetra .-

tion surveillance tests indicates that you rely heavily on contractors to

develop your fire protection program without providing~ adequate independent-

oversight. These concerns have been discussed with your' staff'and we.

understand that you are taking action to. correct them. We. will continue to -

.

monitor your progress in this area. ,
