JAMES A. FITZPATRICK NUCLEAR POWER PLANT- REQUEST FOR ADDITIONAL INFORMATiON REGARDING PROPOSED INCREASE IN SPENT FUEL POOL CAPACITY (TAC NO. M99824)

Dear Mr. Knubel:

On October 14,1997, on behalf of the New York Power Authority (NYPA, also known as the Power Authority of the State of New York), you requested changes to the James A. FitzPatrick Nuclear Power Plant Technical Specifications to increase the capacity of the spent fuel pool.

Due to problems encountered with the installation of a spent fuel rack, on December 3,1998, you provided a revision to this request, reflecting a reduction in the spent fuel pool capacity.

During the initial NRC revicw of this revision, questions have arisen associated with a change to Table 5.6.1, which provides minimum time to boiling and required coolant makeup rates for 2 loss of spent fuel pool cooling scenarios. Specifically, the time to boil for Case 2 decreased, while the required makeup flow increased. Such a change was not expected, since the slight reduction in spent fuel capacity would tend to increase time to boil, and reduce required makeup flow. In discussions with your staff, it was stated that the changes resulted from errors in the application of the TBOIL computer program used by your contractor, Holtec intemational, for this cc'culation.

Since this change was not described in your Dacember 3,1998, submittal, or in the attached Holtec report, the NRC is requesting additional information in order to complete its review of your application. The specific information requested is described in the enclosure to this letter.

The NRC staff finds that the failure to discuss the changes to Table 5.6.1 represents an avoidable failure to provide adequate information to support review of the proposed ,

amendment. The staff believes that since the nature of the changes is counter-intuitive (i.e., I shorter vs. longer time to boil for reduced pool capacity), it is obvious that some discussion of the reason for the changes is required. The staff believes that this information should have f

been provided by Holtec directly or in response to inquiries from your staff, or provided by your p f d staff independent of Holtec. You should also be aware that the revisions to the Holtec report provided in your December 3,1998, submittal did not clearly identify changes from the original October 14,1997, submittal.

REQUEST FOR ADDITIONAL INFORMATION PROPOSED INCREASED SPENT FUEL POOL CAPACITY f JAMES A. FITZPATRICK NUCLEAR POWER PLANT

1. Provide a brief description of the TBOIL computer program, including a discussion of the calculation  ;

method and key assumptions. j

2. Provide a description of the TBOIL error which led to the changes in Table 5.6.1. Discuss why this error affected Case 2, but not Case 1.

l 3. Discuss how NYPA has confirmed that the values provided in Table 5.6.1 are now correct.

4. For Cases 1 and 2, provide the foliowing:

- decay heat load

- mass of water available for heating

-initial conditions

- descriptions of any heat sinks other than the spent fuel pool water that are assumed to be available, such as heat absort>ed by the fuel and pool structures, or heat transfer via evaporation or conduction

5. Provide a discussion of the assessment NYPA and Holtec have completed to assess whether the TBOIL problem should be reported pursuant to 10 CFR Part 21. This assessment should include a discussion of whether revisions are required for other spent fuel pool capacity submittals which rely upon Holtec analyses.
