- Antitrust Operating License Review; Responses to Regulatory Guide 9.3

Dear Mr. Counsil:

Due to the substantial lapse of time since the antitrust settlement in the captioned case and the scheduled fuel loading for Comanche Peak, the NRC staff would appreciate it if Texas Utilities Electric Company, acting as the lead applicant, would provide responses to the Commission's Regulatory Guide 9.3 (copy enclosed) pertaining to the applicants' changed activity since the September 15, 1980 antitrust settlement. (Though the settlement agreement before the Nuclear Regulatory Commission was not finalized until May 6, 1982, the elements of the settlement were presented to Commission staff in September

~o f 1980.) -Your answer to Item B.2 of Regulatory Guide 9.3 should include those actions or policies which have been implemented in accordance with the antitrust settlement. (This response should be specific, giving names, dates and particulars pursuant to the implementation of the license conditions accompanying the antitrust settlement.)
