This refers to the inspection conducted by Mr. P. C. Wagner of this office
during the period August 20-24, 1990 of activities authorized by NRC Operating
1.icense NPF-87'and Construction Permit CPPR-127 for Comanche Peak Steam

Electric Station _(CPSES), and to the discussion of our findings with you,

Mr. A. B; Scott, and other members of your staff at the conclusion of the
inspection. This also refers to the discussion held between Mr. D. Chamberlain
,
of ry staff and Mr. W. G. Guldemond of your staff on September 12, 1990.
Areas examined during the inspection included Measuring and-Test
Equipment (M&TE) and the system to mitigate an Anticipated Transient Without
Scram (ATWS). 'Within these areas, the inspection consisted of selective
examination of procedures and representative records, interviews with
personnel, and observations by the inspector. The inspection findings are
documented in the enclosed inspection report.
During this inspection, it was found that certain of your activities were in-
.
violation of NRC requirements. The first violation involved the failure to
have adequate administrative controls to ensure that the ATWS mitigating
'

system (AMSAC)wasoperable. Consequently, you are required to respond to

this violation, in writing, in accordance with the provisions of Section 2.201
of the NRC's " Rules of Practice," Part 2, Title 10 Code of Federal
Regulation. Your response should be based on the. specifics contained in the
Notice of Violation enclosed with this letter.
The second violation' involved the failure to follow facility procedures for

MATE control and is described in paragraph 2.2 of the inspection report.
However, in accordance with Section V.A. of the NRC's Enforcement Policy
(10CFRPart2,AppendixC),nocitationisbeingissued,andnowritten
response is required.
The response directed by this letter is not subject to the clearance procedures
of the Offee of Management and Budget as required by the Paperwork Reduction
Act of 1986, Pl 96-511.
