We have reviewed your letter of Hey 2,1990, in response to our letter and

Notice of Violation dated April 2,1990, in which you concluded that a

violation of 10 CFR 50.9(a) did not occur. Your conclusion was based

primarily on the belief that an adequate review of the other Code Y procure-

ments had been conducted, that the findings of that review did not affect

the corrective actions resulting from the service water system coating removal,

and that the results of that review were available to the NRC at the Comanche

Peak site.

We continue to believe that you could have provided a more comalete description

of your findings for the other Code V procurements in your docketed response to

EA 88 310 and, thus, we conclude that the violation did occur. However, we also

recognize that our conclusion is based on a subjective judgment regarding the

degree of completeness in your response.

We note that you are already implementing improvements in the process for

,

evaluating and correcting deficiencies, as part of the corrective actions

,

resulting from EA 89-219 and other cocunitments described in your letter of

February 2, 1990. These process improvements include measures to more thoroughly

and consistently evaluate the rsot.cause of deficiencies and events, in such a

way that your findings can be better communicated.

In addition with this one

exception, our experlence over the last two years has been gener, ally favorable

regarding your providing complate' and accurate'information to the NRC.

Accordingly we have determined that the purpose of the enforcement action has

been served,and that no additional response to the Notice of Violation is.

required.

Violation 445/8923-V.01: 446/8923-Y-01 will be closed in our next

monthly inspection report. We will continue to monitor the effectiveness of your

process improvements and cossm;nications during future routine inspections.
