Subject: Inspection 50-333/86-13

This refers to the routine inspection conducted by Mr. A. Luptak of this office

on August 9 to September 29, 1986, at the J.A. FitzPatrick Nuclear Power Plant,

Scriba, New York. Mr. Luptak discussed the inspection findings with you and

other members of your staff at the conclusion of the inspection.

Based on this inspection, two apparent violations of NRC requirements have been

identified and these are described in the enclosed Appendix A, Notice of

Violation. You are required to respond to this letter following the instructions

in Appendix A.

The failure to notify the NRC Operations Center of an event within the required

time, is a repeat of a violation cited in NRC Inspection Report 50-333/85-31,

issued on February 27, 1986. The corrective actions to the previous violation

were scheduled to be implemented by July 1986; however, these actions had not

been established or implemented when the repeat violation occurred in September

1986. We are concerned that your corrective actions were not established or

implemented in a timely manner consistent with you commitments. Please address

this concern in your response to this letter.

The responses directed by this letter and the accompanying Notice are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.
