ORDER IMPOSING CIVIL MONETARY PENALTY This refers to your letter dated April 14, 1988, in response to the Notice of Violation and Proposed Imposition of Civil Penalty sent to you by our letter dated March 17, 1988. Our letter and Notice described violations identified during inspections at your facility during the period from Octcber 1 through November 18, 1987.

To emphasize the importance of providing an appropriate level of nanagement oversight of safety-related activities to preclude procedural control weaknesses, a civil penalty of One Hundred Thousand Dollars ($100,000) was proposed.

In your response, you admit all ten violations as set forth in the Notice.

However, you requested mitigation of the proposed penalty for several stated reasons, primarily because of your belief that the NRC inappropriately aggregated the violations to issue both a Severity Level III violation and to increase the base amount of the civil penalty and that your corrective actions did not merit escalation of the civil penalty.

After consideration of your response, we have concluded for the reasons given in the Appendix attached to the enclosed Order Imposing Civil Monetary Penalty that you have not provided an adequate basis for mitigation of the proposed penalty. Accordingly, we hereby serve the enclosed Order on Wolf Creek Nuclear Operating Corporation imposing a civil monetary penalty in the amount of One Hundred Thousand Dollars ($100,000). We will review the effectiveness of your corrective actions during a subsequent inspection.
