Gentlemen:

This letter refers to the inspection conducted by- tir. M. E. Skow and Ms. L. L.

.

Gundrum of..this office during the period July 1-31, 1990. This inspection

pertained to activities authorized by NRC Operating License No.'MPF-42 for the

,

Wolf Creek Generating Station, and our findings were discussed w'th you and

'

other members of your staff at the conclusion of the inspection.

Areas examined during the inspection included plant status, operational safety

verification, monthly surveillance' observation, monthly maintenance'

observation, and onsite followup of events at operating power reactors. Within

these areas, the inspection consisted of selective examination offprocedures

and representative records, interviews with personnel, and observations by the

inspectors. The inspection findings are documented in the enclosed inspection

'

report.

'

During this inspection, it was found that certain of your activities were in

violation of NRC requirements. The first violation concerned a licensed

operator assuming a watch for which he had not maintained an.' active license.

Since the error was noted and the operator relieved, this occurrence normally

would result in a noncited violation.

In this instence a Notice Of Violation

is bemg issued because management was unaware of the. event for over a week

until notified by the inspector. As a result, a timely assessment-for

corrective actions was not conducted. Consecuently, you are required to respond

to this violation, in writing, in accordance with the provisions of Section

2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code.of Federal

Regulations. Your response should be based on the specifics contained in the

enclosed Notice of Violation. Your response should include your assessment of

this-apparent communications problem and describe any actions taken or'planried

to ensure-that management is promptly informed of identified violations and

other significant matters.

Concerning the second violation, the NRC concludes that the falsification of

secondary chemistry records constitutes a violation of Technical Specification 6.8.4, which requires such records to be maintaineo, and a

violation of 10 CFR 50.9, which stipulates that information required to be

maintainea by a licensee must be accurate. While NRC does not condone

violations of this nature and, in f act, considers the falsification of any

required recoro a most serious matter, NRC- does recognize Wolf Creek Nuclear-

Operating Corporation's (WCN0C's) actions in regard to this n:atter.

Specifically, the NRC staff recognizes that WCNOC initiated an investigation

which resulted in the prompt. discovery of th_is falsification, took prompt-

action to address the plant cheaical parameter concerns raised by this dis-

covery, took significant disciplinary action against the individual involved,

and informed NRC of this matter. Therefore exercise of the discretion in

Section V.G. of the NRC Enforcement Policy (10 CFR Part 2, Appendix C) will be

applied in this case and no citation for. the second violation will be issued.;

This decision was nade after consultation with the Director of the Office of

Enforcement and the Deputy Executive Director for Nuclear Reactor Regulation,

Regional Operations, and Research.

The response directed by this-letter and the accompanying Notice is not' subject-

to the clearance procedures of the Office of Management and Budget as required

-

by the Paperwork Reduction Act of 1980, PL 96-511.
