This is in response to that portion of your January 31, 1986, letter which transmitted a Fundamental Nuclear Material Control Plan to the NRC as required by 10 CFR 74.31.

We have reviewed the subject Plan and have a number of comments and questions enclosed to this letter which have to be addressed in a satisfactory manner before the Plan can be incorporated as a condition of license.

Wehave determined that the enclosure to this letter and the attachment to your January 31, 1986 letter contain information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such infor-mation is deemed to be comercial or financial information within the mearning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
