Certificate of Compliance No. 9203, DHTF Package In accordance with 10 CFR 71.95 (c), as the licensee we are required to report instances in which the conditions of approval in a Certificate of Compliance (CoC) are not observed in making a shipment.

DHTF Licensing Drawing 1249874E specifies that the drum for this container be as

.059 Lid,12 Gage Closure Ring with Drop Forged Lugs,5/8" Bolt w/ Nut or UN1A2/X400/S" The Certificate of Compliance for the DHTF container states:

"...The 16-gauge steel outer drum is approximately 34 inches high and 22.5 l

inches in diameter. The drum closure is a 16-gauge lid with a 12-gauge bolt locking ring with drop forged lugs, one of which is threaded, having a 5/8-inch diameter bolt and lock nut."

During recent maintenance / refurbishment of DHTF containers at the LMF, the "UN" designated drums were found to have a body and lid thickness of approximately 0.045-inch in lieu of a 16 gage thickness (0.053 minimum allowable) per the 1986 version of 49CFR178 for 17C drums.

Since these drums were not dimensionally " equivalent" to a DOT 17C drum, all DHTF "UN" designated drums were immediately located and removed from service by the LMF. Only drums specifically marked by the manufacturer as 17C are now in service.

Backaround The on'ginal DHTF containers were purchased with the specification that the outer drum be a DOT 17C drum. At that time, the industry standard specifically defined material -

- thickness for the body, lid and closure rings.

Later, the LMF placed an order for DHTF drums based upon the code (UN1 A2/X400/S) for specifying a DOT 17C drum. This new code was based upon a new version of the-industry standard that no longer specifically referenced a 17C drum but instead used a.

"UN" designation code. Drum suppliers stated they would provide the LMF with drums that were equivalent to a DOT 17C drum. Current drum advertisements still make these statements. These "UN" designated drums were received by the LMF and

. released for use based upon the vendor's certificate of conformance to the designated code.

Again, no fuel shipments have been made using the DHTF packages purchased to the "UN" code since the discrepancy was brought to attention on February 23,1998.
