This-is.in response to your letters dated March 6 and 25, 1987 concerning the shutdown of your low enriched uranium fuel fabrication activities for the period of June' 15, 1987 to August 31, 1987 inclusive..

Since the facility essentially.will be a storage area during the shutdown period, except for the shipment'of finished fuel assemblies, we have determined that granting' substantial exemptions to the materia 1' control and accounting

-requirements will not adversely affect the common defense and security nor the public health and safety and are otherwise in the public interest.

.Accordingly,'for the period of June 15 to August 31, 1987 inclusive,.the licensee shall follow the enclosed license condition to Safeguards Amendment MPP-2 to License No. SNM-1168 and 10 CFR Part 70 regulations not exempted by the condition for material control and accounting purposes.

exempt from the requirements of 10 CFR 70.51(e) and (f), 70.57 and 70.58 and Sections 1.0 through 8.0 of Safeguards Amendment MPP-2 to License No.

SNM-1168 subject to the following conditions:

1. The only allowed activity is the shipment of finished fuel assemblies.

2. Processing or movement of SNM, other than in 1 above, shall require prior notification and approval of the NRC and the activity shall be subject to the appropriate above exempted regulations and license conditions.

3. Receipts of SNM shall remain unopened until NRC approval is obtained for measuring and storage or processing and the appropriate above exempted regulations and license conditions are implemented.
