NRC INSPECTION REPORT NO. 70-1201/99-01 AND NOTICE OF VIOLATION

Dear Mr. Matheson:

This refers to the inspection conducted on May 24 through 28,1999, at the Lynchburg Manufacturing Facility. The purpose of the inspection was to determine whether activities i authorized by the license were conducted safely and in accordance with NRC requirements. At i the conclusion of the inspection, the findings were discussed with those members of your staff .

l Areas examined during the inspection are identified in the report. Within these areas, the I inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progress.

Based on the results of this inspection, certain of your. activities appeared to be in violation of NRC requirements, as specified in the enclosed Notices of Violation (Notice). These violations involved the failure to perform biennial reviews of several operating procedures, the failure to keep a security gate closed and locked while not in use or attended, and the failure to perform the semi-annualin-vitro bioassays for the second half of 1997. The failure to perform the f biennial review of operating procedures is of concem because it is a repeat violation. The corrective actions for the earlier violation should have prevented recurrence of this problem.

The NRC has concluded that information regarding the reason for the violations, the corrective actions taken and planned to correct the violations and prevent recurrence is already adequately addressed on the docket in the enclosed inspection report. Therefore, you are not required to

.. bspond to these violations unless the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional

- information, you should follow the instructions specified in the enclosed Notice, in accordance with 10 CFR 2.790, of the NRC's " Rules of Practice," a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
