Dear Mr. Alto:

This letter concerns the Facility Attachment for the implementation at your facilityon Treaty of the theNon-Proliferation Safeguards Agreement of Nuclearand Subsidiary Weapons NPT) (Arrangements between the US under and thethe International Atomic Energy Agency (IAEA). This action represents the transference of your low enriched uranium fuel fabrication facility from participation under Article 2(a) of the Protocol to the Agreement to Article 39(b) of the Agreement.

In accordance with the provisions of 10 CFR 75.8(b), Safeguards Amendment SG-1 to your-License No. SNM-1168 is amended, effective upon receipt.of this lette'r, to revise License; Condition 3.1 as follows:

3.1 The licensee shall follow Codes I through 7 of Facility Attachment-No. 6b dated May 9,.1989 to the US/IAEA Safeguards Agreement.

The Facility Attachment is Encicsure 2 of this' letter.

In addition, Safeguards Amendment SG-1 to your License No. SNM-1168 is amended, ~

effective upon receipt of this letter,.to add clarifying license conditions as an addendum. These license conditions are intended to clarify the meaning and intent of certain lenguage contained in specific sections of the Facility-Attachment. The conditions are as discussed between C. W. Emeigh of the NRC's International Safeguards Branch and B&W Fuel Company, CNFP's R. W. Pugh and J. T. Anderson in a telephone conversation on June 2, 1989 (the Addendum to Safeguards Amendment SG-1 is Enclosure 1 of this letter).

i It should be noted that the marking on the enclosed Facility Attachment that reads, " Safeguards Confidential" is of IAEA origin and has no connotation with regard to any domestic (US) security classification.
