This is with reference to our letter of March 31, 1986, in which we agreed to continue the suspension of our civil penalty proceeding pending completion of judicial action on the case involving the Department of Labor's Decision and Final Order dated June 14, 1984 which was the basis for the NRC action. On June 30, 1986, the Supreme Court denied the writ of certiorari sought by KG&E, Kansas Gas & Electric Co. v. Brock, 780 F. 2d 1505 (10th Cir. 1985), cert.
denied, 54 U.S.L.W. 3858, thus concluding all pending judicial action in the case. Accordingly, you should now respond to the Notice of Violation,and Proposed Imposition of Civil Penalty dated September 27, 1984. Your time to answer the September 27, 1984 Notice expires thirty days from the date of this letter.
