Gentlemen:

SUBJECT: NOTICE OF VIOLATION AND NOTICE OF DEVIATION

(NRC INSPECTION REPORT NO. 50-458/86-22)

This refers to the inspection conducted by Mr. R. E. Baer of this office during

the period June 30 through July 3, 1986, of activities authorized by NRC

Operating License NPF-47 for. River Bend Station, and to the discussion of our

findings with yourself and other members of your staff at the conclusion of the

inspection.

Areas examined during the inspection included the solid radioactive waste

-management. system and transportation activities. Within these areas, the

inspection consisted of selective examination of procedures and representative

records, interviews with personnel, and observations by the inspector. The

inspection findings are documented in the enclosed inspection report.

During this inspection, it was found that certain of your activities were in

..

violation of NRC requirements. Consequently, you are required to respond to

this violation, in writing, in accordance with the provisions of Section 2.201

of the NRC's " Rules of Practice," Part 2 Title 10 Code of Federal

j Regulations. Your response should be based on the specifica contained in the

Notice of Violation enclosed with this letter.

This violation which is described in the enclosed Notice has already been the

'

subject of enforcement action by the state of South Carolina. On May 28, 1986,

the state of South Carolina assessed a civil penalty of one thousand dollars

($1,000.00) and prohibited further shipments of solidified resin from being

transported into that state. In view of the circumstances surrounding this

'

matter, we have exercised our discretion under the NRC Enforcement Policy.

of Violation without assessing a civil penalty. After reviewing your response

to this Notice of Violation and your proposed corrective actions, the NRC will

determine whether further NRC enforcement action is necessary in order to ensure

compliance with NRC regulatory requirements.

Also during this inspection, it was found that certain of your activities

appeared to deviate from accepted commitments made to the NRC. This item and

reference to the commitments are identified in the enclosed Notice of Deviation.

You are requested to respond to this deviation in writing. Your response

should be based on the specifics contained in the Notice of Deviation enclosed

with this letter.

The responses directed by this letter and the accompanying Notices are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.

Should you have any questions concerning this inspection, we will be pleased to

discuss them with you.
