RIVER BEND STATION (RBS), UNIT 1 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO. MA4545)

Dear Mr. Edington:

By application dated December 16,1998, and General Electric Company's (GE's) affidavit dated October 6,1998, executed by Craig P. Kipp, General Manger, Nuclear Fuel, GE, you submitted a license amendment request on recirculation loop minimum critical power ratio (MCPR) limits and requested that Attachment 4, " Final Calculation of RBS Cycle 9 SLMCPR (Safety Limit for MCPR]" be withheld from public disclosure pursuant to 10 CFR 2.790. The information considered proprietary by GE is identified in Attachment 4 by enclosing the phrase with double brackets (e.g., 'HGENE proprietary information))").

The affidavit stated that the submitted information should be considered exempt from mandatory public d6 closure for the following reasons:

[The] information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GE's competitors without license from GE constitutes a competitive economic advantage over other companies.

(The] information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the j

design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.

(8) The information...is classified as proprietary because it contains details of GE's Safety Limit MCPR analysis and the corresponding results which GE has applied to River Bend's actual core design with GE's fuel.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the Nuclear Regulatory Commission (NRC). You also should understand that the NRC may have cause to review this determination in the future, fer example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
