APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Docket: 50-458/86-22 River Bend Station License: -NPF-47 As a result of an investigation conducted on May 23, 1986, by a representative of the South Carolina Department of Health and Environmental Control of a-shipment of licensed material sent from your facility in St. Francisville, Louisiana, and in accordance with the NRC Enforcement Policy, 10 CFR Part 2,

10 CFR Part 30.41(c) prohibits transfer of byproduct materials unless it

Condition 32.B'of South Carolina License No. 97, an Agreement State

-License issued to Chem-Nuclear Systems, Inc., prohibits the receipt of solidified waste witti " detectable free standing liquid" which is defined

. Contrary to,the above, on'or about May 19, 1986, the licensee caused to be made a. transfer of a waste shipment of byproduct material containing

/ _ .70 mil 11 curies of spent resins solidified in cement to Chem-Nuclear Systems, Inc., at Barnwell, South Carolina. The shipment, which was received on May 23, 1986, had 3.7 percent free standing liquid within the" liner.)

This is a Severity Level III violation. (Supplement V)

Pursuant to the provisions of 10 CFR 2.201, Gulf States Utilities is hereby required to submit to this office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation, including:

(1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
