NRC INSPECTION REPORT NO. 50-458/99-07
Dear Mr. Edington:
This refers to inspection Report 50-458/99-07 in which two apparent viciations were identified
and are being considered for escalated enforcement action. The first appcrent violation
involved inadequate work instructions that resulted in improper maintenanc r on the Division i
emergency diesel generator. The second apparent violation involved exceeding the Technical Specification 3.8.1 limiting condition for operation regarding the emergency diesel generators.
The inspection report cover letter indicated that a predecisional enforcement conference, to
discuss these apparent violations, was being arranged. However, after reevaluating the case,
we have determined that a predecisional enforcement conference may not be needed because
the significance of the issues and the need for lasting effective corrective actions were
discussed with members of your staff at the exit briefing. As such, we are providing you an
opportunity at this time to either: (1) respond in writing to the apparent violations addressed in
l
the inspection report within 15 days of the date of this letter or (2) request a predecisional
'
enforcement conference. If a conference is held, it will be open for public observation. The
NRC will also issue a press release to announce the conference. Please contact
William D. Johnson at (817) 860-8148 within 7 days of the date of this letter to notify the NRC
of your intended response.
If instead of a predecisional enforcement conference you should decide to respond to these
i
apparent violations in writing, your response should be clearly marked as a " Response to
Apparent Violations in Inspection Report No. 50-458\\99-07." It should include for each
l
apparent violation: (1) the reason for the apparent violation or, if contested, the basis for
l
disputing the apparent violation; (2) the corrective steps that have been taken and the results
l
achieved; (3) the corrective steps that will be taken to avoid further violations; and (4) the date
when full compliance will be achieved. Your response should be submitted under oath or
i
affirmation and may reference or include previous docketed correspondence, if the
!
'
correspondence adequately addresses the required response. If an adequate response is not
received within the time specified or an extension of time has not been granted by the NRC, the
NRC will proceed with its enforcement decision.
