Gentlemen:

We have carefully reviewed your response to Inspection Report No. 50-440/8f308

tiansmitted by your letter dated May 28, 1986.

With regard to Notice of Violation 50-440/86008-03, we acknowledge your

corrective actions and have no further questions at this time.

With regard to Notice of Violation 50-440/86008-04, we believe the violation

should stand as written for the following reasons:

With regard to Criteria No. 4 of 10 CFR 2, Appendix C (It was or will be

corrected, including measures to prevent recurrence, within a reasonable

time.): The measures which were finally agreed to in SPP-1401 were

adequate only after numerous discussions with your staff. Initial

actions proposed by your staff were inadequate.

With regard to Criteria No. 5 of 10 CFR 2, Appendix C (It is not a

Violation that could reasonably be expected to have been prevented by the

licensee's corrective actions for a previous violation.): While you are

correct that the NRC did not list this as a repeat violation, there were

previous examples where the need to have control over activities

affecting quality were cited at the Perry facility. (Forexample, refer

to Inspection Report No. 50-440/85017). This was not an isolated case

in which several valves were mispositioned; rather, it was a case in

which several valves were mispositioned without quality systems control.
