SAFETY EVALUATION OF RELIEF REQUESTS IR-032 to IR-041 IMPLEMENTATION OF SUBSECTION IWE AND IWL OF ASME SECTION XI FOR CONTAINMENT INSPECTION - PERRY NUCLEAR POWER PLANT (TAC NO. MA3426)

Dear Mr. Myers:

The second 10-year interval for the inservice Examination Program at the Perry Nuclear Power Plant began on November 18,1998. Therefore, the latest edition and addenda of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code applicable to Class MC and CC components incorporated by reference in 10 CFR 50.55a(b)(2) 12 months prior to the start of Perry's second inspection interval isSection XI Division 1,1992 Edition with the 1992 Addenda, subject to the limitation listed in paragraph 10 CFR 50.55a(b)(2)(vi) and the ,

modifications listed in paragraph 10 CFR 50.55a(b)(2)(ix) and (x). By letter dated August 20,  !

1998 (PY-CEl/NRR-2291L), and as supplemented by submittal dated April 1,1999 (PY- l CEl/NRR 2383L), FirstEnergy submitted relief requests pursuant to 10 CFR 50.55a(g)(5)(iii) and  ;

(iv) from certain examination requirements of Section XI of the ASME Code.

l The staff, with technical assistance from the Idaho National Engineering and Environmental Laboratory (INEEL) has completed the review of the subject relief requests. The staff concludes that for Requests for Relief Nos. IR-033, IR-034, IR-35, IR-038, and IR-039, the licensee's ,

proposed alternatives will provide an acceptable level of quality and safety. Therefore, these proposed alternatives are authorized for the second 10-year inservice inspection (ISI) interval pursuant to 10 CFR 50.55a(a)(3)(i). For Requests for Relief Nos. IR-032, IR-037, and IR-040, the staff concludes that compliance with the Code requirements would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety and that the licensee's proposed alternatives will provide reasonable assurance of containment structural integrity. Therefore, these proposed alternatives are authorized for the second 10-year ISI g interval pursuant to 10 CFR 50.55a(a)(3)(ii). / O\
