Reference:

PSNH Letter (NYN-88083), dated June 15, 1988, "Anticipated Transient Without Scram (ATWS)", from: George S. Thomas, to:

Document Control Desk The referenced letter requested that your comitment to install an ATWS )

Mitigation System and have it functional prior to startup from the first refueling outage, no later than July 1989, be delayed until startup from the first refueling outage. You also requested that your commitment to provide plant specific design information for this system be revised to supply this information no later than the end of the first quarter of 1989 rather than six months prior to the first refueling outage.

As noted in the referenced letter, the ATWS Mitigation System will be a risk reduction enhancement modification for the Seabrook facility. Since the staff originally expected that the plant would be operated without the ATWS Mitigation System during the first fuel cycle, we agreed that delaying installation of this system beyond July 1989 and until the end of the first fuel cycle will not effect the existing plant margin of safety or provide a significant increase in risk. However, we note that our generic SER concerning ATWS mitigation systems for Westinghouse plants (WCAP-10858) was issued in July 1986 (two years ago) and that actions should be taken soon to submit the plant specific design information. Our current schedules indicate that plant specific design information will be submitted by all other Westinghouse plants by the end of 1988, and this supports our review process in an orderly and timely manner. Therefore, we request that the plant specific design information for the Seabrook ATWS Mitigation System be submitted by the end of 1988.

With regard to installing and making the Seabrook ATWS Mitigation System functional, we note that our ex,nactations are being met in that current schedules indicate that all other West 1nghouse plants will have their ATWS mitigation systems installed and functional by September 1990. We recognize that uncertainties in the licensing and startup of the Seabrook plant may cre6te scheduling difficulties for the installation of the ATWS Mitigation System. Although we would not require a plant shutdown solely to install this system, we believe that Seabrook can and should install and have its ATWS Mitigation System functional by September 1990. be met even with the uncertainties in the Seabrook licensing schedule for the following reasons:

(1) If a low power license and a full power license are issued within the near future, it may be possible to complete the first fuel cycle before September 1990 and the system could then be installed during that outage.

(2) If a low power license is issued within the near future but issuance of a full power license is delayed, the system could and should be installed during an outage between issuance of the two licenses.

(3) Likewise, the system could and should be installed prior to licensing if there is a significant delay in issuance of a low power license.

(4) Another opportunity to install the system would occur if there were an extended outage subsequent to initiating power operation but prior to completing the first fuel cycle.

9ased on the foregoing, we agree to revise the schedule for installing and having the Seabrook ATWS Mitigation System functional to no later than September 1990. This modification to your proposed change of schedule has been mutually agreed upon upon by the Comission (Brinkman, Newberry) and licensee (Mr. Rob Sweeney, Manager, Bethesda Licensing Office).
