l The final rule, " Fitness-for-Duty Programs," 10 CFR 26,  ;

j was issued in the Federal Register (FR) on June 7, 1989 (54 FR ,

j 24468). This rule became effective on July 7, 1989 and, in

  • L accordance with 10 CFRR2 6 .2(c), is required to be implemented no 3 later than January 3, 1990. Furthermore, 10 CFR 26.73(d) requires that each licensee chall certify to the NRC that it has implemented ,

a fitness-for-duty program that meets the requirements of 10 CFR 26, ,

and that the certification shall describe any licensee chemical ,

testing cut-off-levels more stringent than those imposed by 10 CFR

26. .Our letter dated January 3, 1990 stated that we were performing a confirmatory review of the fitness-for-duty program implemented at the Philadelphia Electric Company (PECo), and that upon completion of this review by the end of January, 1990, I would certify by  !

l January 31, 1990, that PEco has implemented a fitness-for-duty program that meets the requirements of 10 CPR 26. Our January 3, .

off levels included in the PECo fitness-for-duty program which are in addition to the testing for substances at the cut-off levels l specified by 10 CFR 26. Our confirmatory review has been completed and this letter provides our certification regarding the implementation of a fitness-for-duty program at PECo.

Accordingly, I certify that to the best of my knowledge a fitness-for-duty program that meets the requirements of 10 CPR 26, has been implemented at PECo. While the PECo fitness-for-duty I program includes the requirements of 10 CPR 26, confirmation that '

vendor supervisors located off-site (i.e., at the vendor location) received the required training from the vendor organization will be performed as part of our normal audit program.
