Dear Judges Kelley,

Bright & Carnenter:

After a couple of failures to catch Tom Baxter, I sooke with John O'Neill (CP&L attorney) today concerning "the Harris opers. ting cost data which Aunlicants had earlier said would be filed in ER Amendment 4, which is not in there. These are the cost' data required "to be beaten" prima facie in a 10 CFR 2.758 petition concerning need for power.

O'Neill says these data were not included since many connuter runs are required for the sensitivity analysis of operating costs for the CP&L system with and without Harris , which CP&L is doing.

i He hopes to get this data filed in a further ER amendment by the m end of 1982, but said he should not be held to that date.
