Dear Mr. Tye:

This is in response to your letter dated May 28, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), documentation pertaining to the April 4 and April 11 scrams at the Pilgrim 1 nuclear power plant and NRC follow-up inspections.

The enclosed Appendix A identifies documents which are being placed in the NRC's Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555, where they will be available for public inspection at no charge, or reproduction at a nominal charge of five cents ($0.05) per page, as specified in 10 CFR 9.14.

The documents will be filed in PDR folder FOIA-86-419 under your name. We are enclosing a notice that provides charges and procedures for obtaining records from the PDR. The enclosed Appendix B identifies a document which the NRC has already made publicly available at the PDR.

Portions of document 6 on Appendix A contain information which is confidential busir.ess (proprietary) information. This information is being withheld from public disclosure pursuant to Exemption (4) of the F0IA (5 U.S.C. 552(b)(4))

and 10 CFR 9.5(a)(4) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Thomas E. Murley, Regional Administrator, Region I.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U. S. Nuclear Regulatory Commission, Washington, DC 20555, and shc'ild clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
