Since January 1986, your staff has sent Region III the latest revisions to the Dresden, Braidwood, and LaSalle Station Annexes to the Generating Stations Emergency Plan. Based on telephone conversations between Mr. G. Alexander of your staff, and Mr. T. Ploski of my staff,'we understand that a Commonwealth Edison Company chet.k in the amount of $150.00 was sent separately or along with each of these three annex revisions as an application fee for the review of each document.

One of the functions of my emergency preparedness staff is to review all emergency plan changes for all operating plants in Region III, plus the Braidwood Station. The results of these reviews are documented in letters to the licensee or in Safety Evaluation Reports. Be advised, however, that 10 CFR 50.54(q) indicates that no app 1'ication fee to perform these reviews is currently required, unless the changes to an emergency plan are determined by the staff to decrease the plan's effectiveness. Whether such changes would then be acceptable is a matter separate from the need to submit an application fee for reviewing emergency plan changes that decrease a plan's effectiveness.

Regarding the three application fees which Mr. Alexander stated had already been submitted for the reviews of the three annex revisions, my staff has assured me that only Commonwealth Edison Company Check No. 0028462 for $150.00 had been received by them as an application fee associated with the LaSalle Annex' revision. The whereabouts of application fees associated with Revision 1 to the Braidwood Annex and Revision 4 to the Dresden Annex are unknown to me and my staff. Therefore, Commonwealth Edison Company Check No. 0028462 is hereby being returned to you. We suggest that you arrange to have bank payment stopped on any application fees associated with the recently submitted revisions to the Braidwood and Dresden Annexes. A copy of this letter is being sent to the*NRC License Fee Management Staff, Office of Administration.
