REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. MA6070 AND MA6071)
Dear Mr. Kingsley:
By letter from Commonwealth Edison Company (Comed) dated July 14,1999, and Ger:aral Electric Company's (GE) affidavit executed by George B. Stramback, dated July 12,1999, you submitted a pioprietary document entit!ed, " Power Uprate Safety Analysis Report for LaSalle County Station Units 1 and 2," Revision 2, Class lil, NEDC-32701P, dated July 1999 and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
GE stated in its affidavit dated July 12,1999, that the information should be considered exempt from mandatory public disclosure pursuant to 10 CFR 2.790 for the following reasons:
(4)a. Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by General Electric's competitors without license from General Electric constitutes a competitive economic advantage over other companies; (4)b. Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product; (8)

codes, which GE has developed, obtained NRC approval of, and applied to perform evaluations of transient and accident events in the GE Boiling Water Reactor ("BWR").

models and computer codes was achieved at a significant cost to GE, on the order of several million dollars.

which represent, as a whole, an integrated process or approach which GE has developed, obtained NRC approval of, and applied to perform evaluations of the safety-significant changes necessary to demonstrate the regulatory acceptability of a

given increase in licensed power output for a GE BWR. The development and approval of this overall approach was achieved at a significant additional cost to GE, in excess of a million dollars, over and above the very large cost of developing the underlying individual proprietary analyses.
J We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of GE's statemerits, have determined that the submitted.
information sought to be withheld contains trade secrets or proprietary commercial information and should be withheld from public disclosure.
Therefore, we have determined that the document entitled, " Power Uprate Safety Analysis Report for LaSalle County Station Units 1 and 2," Revision 2, Class ill, NEDC 32701P, dated July 1999 marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
l Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such thEt the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a freedom of Information Act request includes your information. In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
