Dear Mr. Huge:

This is in further response to your letter dated June 12, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), documents regarding Brown & Root, Inc.

The documents listed on the enclosed Appendix A are subject to your request.

Many of the documents are already available in the NRC Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555, and may be accessed by referring to the PDR accession numbers identified at the documents. Copies of the remaining documents (numbers 1, 5, 7, and 8) will be placed in the PDR and will be filed in PDR folder F01A-84-487 under your name.

The documents listed on enclosed Appendix B contain comments, advice, opinions, and recommendations of the staff during a deliberative process and are being withheld from public disclosure pursuant to Exemption 5 of the FOIA (5 U.S.C.

552(b)(5)) and 10 CFR 9.5(a)(5) of the Comission's regulations. Disclosure of the information would inhibit candid and frank communications in future deliberations and would not be in the public interest. Segregable factual information has already been placed in the public domain.

Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Richard C. DeYoung, Director, Office of Inspection and Enforcement.

t This denial may be appealed to the NRC within 30 days from the receipt of this

< letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and l in the letter that it is an " Appeal from an Initial F0IA Decision."
