Grimsley's response dated January 24, 1989. ; Mr. Grimsley's response denied in part two records subject to your Freedom of l Information Act (F0IA) request for copies of all records related to the - ~ inspection documented in Inspection Report numbers 50-445/88-59 and 50-446/88-55 and to discussions of findings with Mr. Counsil et al., at the conclusion of the inspection. You specifically appealed the denial of portions of the_ records identified on Appendix C of Mr. Grimsley's response dated January 24, 1989, and on the enclosed Appendix. Acting on your apaeal, I have carefully reviewed the record in this case and have determined t1at the previously withheld information will continue to be withheld from public disclosure, pursuant to Evemptions (5) and (6) of the F0IA (5 U.S.C. 552(b)(5) and (6)) and 10 CFR 9.17(a)(5)) and (6) of the Commission's regulations. Therefore, your appeal is denied. The information which was previously withheld pursuant to F01A Exemption 7A is predecisional information that is being withheld pursuant to the deliberative process privilege of Exemption 5. Information continued to be withheld pursuant to Exeaption 6 consists of' names, an address, and a telephone number, the disclosure of which could cause a clearly unwarranted invasion of personal privacy. I am unable to identify any legitimate public interest in the release of this information which outweighs the privacy interests of the individuals. This is a final agency decision. As set forth in the F0IA (5 U.S.C. 552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.
