By petition of May 12, 1989, you requested on behalf of Cap Rock Electric Cooperative, Inc. (Cap Rock) that, pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations (10 CFR) the Director, Office of Nuclear Reactor Regulation issue an order enforcing the Comanche Peak antitrust license conditions. You asserted that Texas Utilities Electric Company (TV) was violating the antitrust license conditions and requested that the Commission require TU to make certain electrical services available to Cap Rock which were provided by the license conditions.

During the course of the NRC's investigation of your allegations, representatives of TV and Cap Rock held settlement negotiations. Members of the NRC staff were present at several of these meetings to aid the parties in resolving their differences. As a result of these negotiations, the parties reached a final settlement on June 21, 1990. On June 28, 1990, you moved to withdraw your 2.206 petition.

The NRC staff accepts Cap Rock's motion to withdraw its petition because this action involves no pending health and safety concerns and appears to satisfy the public interest. Therefore, no further action will be taken by the staff.

We appreciate the efforts by the technical staf fs and counsel of both parties in resolving this matter.

The enclosed notice withdrawing the petition has been forwarded to the Office of the Federal Register for publication.
