Dear Mr. Roisman:

Over the past few weeks we have had a number of discussions regarding completion of the Staff's response to CASE's discovery request of December 4,1986 pertaining to the Report of Investigation prepared by the NR C's Office of Inspector and Auditor on Region IV management actions regarding Comanche Peak. A redacted version of the- Repcrt was provided to the Licensing Board and parties by Board Notification dated December 11, 1986.

During our conversations, we discussed, in general terms, the Staff's proposal to release the OIA Report in unredacted form as well as its attachments, under the terms of a protective agreement and order. The Staff also indicated its intention to include in such protective agreement and order a Report prepared by the Comanche Peak Report Review Group, established to evaluate the OIA Report and develop recommendations for corrective actions in a variety of areas. This Report is commonly referred to as the Arlotto Report.

Subsequent to our conversations, I learned that further investigatory activities, regarding which both the OIA Report and Arlotto Report are central, are underway. In light of such . action, it is not known at this time whether either of the Reports can be disclosed even under the terms of a protective sgreement and order. Accordingly, at present, the Staff is unable to proceed with a further substantive response to your discovery

- request.
