j The NRC Staff (" Staff") has received " Applicants' Motion for Leave to File Motion for Reconsideration" (" Applicants' Motion") (December 6, 1985),

in which Applicants request that the Board reconsider its ruling in the

" Memorandum and Order (Reconsideration of Misrepresentation Memorandum),"

LBP-85-47 (November 25,1985) permitting CASE to conduct further discovery on the subject of misleading statements. Inasmuch as Applicants' Motion seeks reconsideration of a discovery matter between Applicants and CASE, the Staff will not be filing a response to Applicants' Motion.
