SUBJECT:
COMANCHE PEAK ALLEGATION In accordance with this morning's ARC determination, I called Bill Cahill of TV Electric to ask him to follow up on an allegation that a secretary had been raped on site by a Brown and Root Vice President approximately 1 year ago.
I told him we had information that such an incident had occurred z.nd could he shed any light on it. He recalled that there was some issue with a Christmas party which resulted in a secretary suing Brown and Root and that the Vice I
l President in question had resigned as a result. Mr. Cahill did not believe

l the incident had taken place on site or that rape was necessarily the right
{
characterization. He said he would follow up and verify the circumstances and 1
I told him our interest was solely with any potential regulatory issues that j
may be associated with the situation.

As a result of an assault of a security officer at Comanche Peak, numerous questions and concerns have been identified by members of the public.
These questions / concerns include misuse of key f
card system, accountability of security officers, alleged rape of secretary by Brown & Root VP, assault occurred to prevent the victim from identifying concerns about security program, and inadequacies of background screening by TU.

October 23, 1992 Telephone conversation with Micky Dow Mr. Dow telephoned me at approximately 4:00 p.m. to express concern about the female guard that is in the hospital, and that the guard has not been provided police protection. He said, "After all she is a federal witness. He continued by saying the crime was committed on federal property."
I informed Mr. Dow that his understanding of the jurisdiction was incorrect.
Additionally, jurisdiction responsibility was with Somervell County Sheriff, i
not with the FBI or NRC. To my knowledge attempted sabotage to the plant had not been identified.
I told him that NRC had an inspection team onsite to i
evaluate the CPSES security response to the security event that was declared.
Mr. Dow again expressed concerns about the lack of security provided for the guard, and that Glen Rose Hospital does not have the staff to afford any
-ttention to this individual's needs.
She should be transferred to a larger care facility, preferably Harris Hospital in Fort Worth.
Mr. Dow believes that the security guard has information to provide to NRC and if left alone long enough, someone of the licensee staff will intimidate her and she will not provide the information.
Mr. Dow stated that he has been in contact with Walter Layton, US Marshall, regarding contact with the FBI to grant the security guard protection under the federal witness protection program.

I explained that it is not anything that is within my authority to grant.
I further explained that his concerns would be forwarded to Somervell County Sheriff's Office through the liaison contact in this office.

October 23, 1992 Telephone conversation with Mr. Ellis and Mr. Thero of CASE They wanted to report information that has been brought to their attention by individuals working at the site.
Mr. Thero and Mrs.
Ellis have not checked the validity of this information with l
anyone, but believed it should be identified to NRC.
The female guard's name is and the individual that l
committed the crime is elieved to be an AO at the plant.

Reportedly, the two are married, however, not to each other.

Allegedly, they were having an affair, she wanted to end the affair and she told him.
He went into a rage and committed the crime.

I advised Mrs. Ellis and Mr. Thero that the matter was not within the jurisdiction of NRC.
However, the NRC has a team evaluating the CPSES response to the event.
Additionally, we continue to i
pass information related to the event to the Somervell County Sheriff's office.
The FBI is not investigating to my knowledge I
because sabotage of the facility was not suspected or reported by TU.

I October 23, 1992 Telephone conversation with Micky Dow Mr. Dow telephone me this morning at approximately 8:30 a.m.
Hr. Dow started the conversation with "here's your Christmas present.'

Let me tell you how u can reak is alibi, and if you get him arrested I can produce witnesses. He said they fear for their lives, and jobs if the information gets out that they have talked to anyone about the incident.
He continued the conversation by say' tha had to have accomplices in this act.
One the accomplices used c d badge to gain access to an area that would provide him an a 1, wh1 e as " piggy backing" into another area eventually gaining access to the ea ere the attack occurred.
In closing, Mr. Dow requested that I work with him on this one, and he will produce the witnesses to get this guy.

Telephone. conversation with Micky Dow Mr. Dow telephone at approximately 12:30 p.m. to report additional information that he is receiving minute by minute from his source allegedly a family member of the female guard.
He stated that the female guard was sexually assaulted, and sliced with a knife from the neck to the groin area.
The guard allegedly identified a control room operator as the individual that committed the assault.
His source informed him that two weeks earlier the guard had requested a restraining order from the Somervell County authorities and it was not granted.
The control room operator filed counter charges against the guard.
He reported that Burns Security management is very upset that TU did not i
inform them of the specifics of the attack.
Mr. Dow believes that there is more to the attack than it appears to be.
The attack may have initiated to silence a whistle blower who was about to identify concerns.

Telephone conversation with Micky Dow Information that I'm about to. provide to you will be very long and detailed you may want to record this message.
I advised Mr. Dow that I do not record conversations.
This information came from a very reliable source, and is afraid about losing a job.
Mr.
rmed me of the following: The female security guard's last name l and she has a reputation of being promiscuous. She was found on was the per oor of the turbine building for Unit 1.
She was unconscious as a result of a blow to the head. Her shirt had been ripped open. Her pants were around her knees. She had been handcuffed with her handcuffs. Her weapon had been taken, but was later discovered in the holster with the belt in t corner of the room.
She was taken to a hospital, more than likely Harris in Fort Worth or maybe Stephenville.
I do not have a report on her condition.

One person could not have gotten this woman up the ladder to the room alone.
She has accused a control room operator with whom had en having an affair.
Her most recent partner is rumored to be of the CPSES security.
He allegedly received a dozen black ros abou wo weeks ago.

TU Electric issued a " secret memo" yesterday. New policy, effective immediately, after 3:30 p.m. all women will be escorted from their work locations to the parking lots. No females will be permitted on site after dark.
l I want to know why Somervell County has authority over a crime that was
_i committed in NRC jurisdiction? Why hasn't the FBI been contacted?
l TU has issued a " gag" order that if anyone talks about the event, they will be fired.
Allegedly, TV senior managers have said " heads will roll" if any information "gets out."

[h they (security) became concerned, was shift change. This means that for over two hours someone had access to the turbine building, and no one was aware.

Somervell County has been in TV's back pocket for so long. Why would you expect them to do a good job on this matter?

This is not the first tue that this has happened. About one year ago a Brown l
and Root vice president raped a secretary on site. Sexual harassment is a rule rather than the exception, on site.
