Dear Administrative Judges:
Previously, the NRC Staff proposed to respond to the Board's concerns expressed in a November 11, 1985 Memorandum regarding CPRT statistical sampling in a Supplemental Safety Evaluation Report (SSER) evaluating the CPRT Program Plan, Revision 3,
to be published at the end of February 1986.
The Board Chairman agreed to the Staff's proposal, but added that if issuance of the SSER were to be delayed, then the Staff should endeavor to address the concerns raised by the Board in a separate filin g.
See NRC Staff Comments on Statistical Inference Memorandum (January 30, 1966) n.5.
Since that time, the issuance date for that SSER has been delayed beyond the end of February 1986.
Although the Staff promptly began preparing a separate filing responding to the Board's questions when this became evident, it now appears that the Staff will not be able to file its response by the end of February.
Rather, the Staff intends to file its response to the technical concerns raised in the Board's November 11, 1985 Memo-randun by March 14, 1986.
Staff counsel has informed counsel for Applicants and Intervenor CASE's representative, Ms. Garde.
Ms. Garde advises that CASE, too, will be unable to respond to the Board on this matter by the end of February.
We hope that the Staff's brief delay will not inconvenience the Board.
Sincerely, 8603050068 860228 g-s DR ADOCK 050 5
