On February 2, 1993, the NRC received an " Emergency. Motion to Stay Issuance of .l Low-Power Operating License" filed by Kohn, Kohn, and Colapinto (Motion). t The Motion requested that the Comission (1) issue an order staying the  !

issuance of the low power license; (2) grant? petitioners the opportunity to 't review withheld information related to settlement agreements between Texas 1 Utilities Electric Company and the former minority owners of Comanche Peak i Steam Electric Station (CPSES); (3) stay issuance of the low power license. '!

until a final determination is made on the Construction Permit Amendment -  ;

REQUEST FOR $TAY OF ISSUANCE OF THE-LOW POWER OPERATING LICENSE FOR COMANCHE i t PEAK UNIT 2 On February 2, 1993, the NRC received an " Emergency Motion to Stay Issuance of Low-Power Operating License" (Motion). The Motion was filed by Kohn, Kohn and' >

Colapinto. The Motion requested that the Commission 1) issue an order staying the issuance of the low power license; 2) grant petitioners the opportunity to review withheld documentation related to settlement agreements between TU Electric and the former minority owners of Comanche Peak;.3) stay issuance of the low power license until a final determination is made on the Construction Permit Amendment Proceedings for Unit 2; and 4) that. petitioners be granted  ;

oral argument on their motion.

I have been advised by the Office of the General Counsel that's stay is.not in effect. The staff and I have reviewed the Motion and determined that it does -

not identify any significant safety issues. The Petitioners have provided no evidence of any safety concerns, but have only. speculated that such concerns may exist.

4 On the basis of 1) the advice from the Office of General Counsel, 2) the review conducted by the staff and myself, and 3) the Regional Administrator's February 1, 1993 memorandum stating that there are no known safety concerns that should preclude issuing a low power license for Comanche Peak Unit 2, I  ;

have decided it is appropriate to issue the low power license on this date.
