M j,g s I am writing regarding the manner in which the Atomic Ssfety and Licensing Board Order of November 13, 1981 characterizes the respective appearances of the New York State Attorney General and the New York State Energy Office in this proceeding. In that order, reference is made to the receipt of petitions to participate from the " Attorney General of the State of New York on behalf of New York State (State)"
and from the "New York State Energy Office (Energy Of fice) ." I am concerned that this will result in confusion as to who is appearing on behalf of the State of New York and its agencies.
As pointed out in our Petition for Leave to Participate As An Interested State, at paragraph 4, the State Energy Office has the specific statutory responsibility under Section 7-101 of the State Energy Law and Section 104 of the State Commerce Law to appear on behalf of the State and its agencies in proceedings of the Nuclear Regulatory Cwmission.

I would ask that in the future, the Energy Office be noted as appearing on behalf of the State of New York and its agencies.
