ORDER PROHIBITING INVOLVEMENT IN NRC LICENSED ACTIVITIES (NRC OFFICE OF INVESTIGATIONS REPORT NO. 3-1998-003)

Dear Mr. Clark:

The enclosed Order Prohibiting Involvement in NRC-Licensed Activities (Order) is being issued  ;

because of your deliberate misconduct in violation of 10 CFR 50.5 of the Commission's <

regulations when you provided false information to two NRC licensees. Specifically, you deliberately failed to inform Centerior Energy Services and the Power Authority of the State of New York about your prior use of marijuana, your fitness for duty (FFD) test failure, and the subsequent denial of unescorted access to the Philadelphia Electric Company's Peach Bottom nuclear plant. As a result, you improperly gained unescorted access to the Indian Point 3 and Peny nuclear facilities. Based on your actions, the Order prohibits you from working in NRC-licensed activities for a period of one year and requires you to notify the NRC of your involvement in any NRC-licensed activities for one year following the prohibition period.

Pursuant to Section 223 of the Atomic Energy Act of 1954, as amended,42 U.S.C. 2273, any person who willfully violates, attempts to violate, or conspires to violate any provision of this Order shall be subject to criminal prosecution as set forth in that section. Violation of this Order l may also subject the person to a civil monetary penalty. '
