Dear Dr. Reytblatt:

This is in response to your letter dated December 19, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), a list of records related to (1) Director's Decision DD-85-10 and a meeting between you and NRC staff on October 17,1985, and (2) any record documenting a review by Robert Bernero, NRC, of the transcript of the October 17, 1985, meeting.

The enclosed _ Appendices.A,_B,_and C serve as the requested list. I have been informed by the staff that there i'5'no written record of Mr. Bernero's review of the transcript. We reviewed the records identified on the enclosed appendices, and the results of this review are noted below.

With the exception of the floppy disk identified as item 1, for which a user must have his or her own IBM basic program, the 45 records on the enclosed Appendix A are now available for public inspection and copying at the NRC Public Document Room in file folder F01A-86-20 under your name. If you are interested in receiving a copy of the disk, please let us know by May 9, 1986, M and we will provide a copy to you.

The one record _identifieton_the_ enclosed. Appendix _B _is being partially withheld from public disclosure pursuant to Exemption (6)~of the F0IA (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Commission's regulations.

The two exempt portions of this record contain the home telephone numbers of two individuals, the release of which would result in an unwarranted invasion of personal privacy.

The one record identified on the enclosed App'endix C is being withheld in its entirety from public disclosure pursua'nt tiiExemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

This record contains predecisional advice and recommendations by the staff of the Office of the Executive Legal Director to the staff of the Office of Nuclear Reactor Regulation. The release of this record would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.

Dr. Reytblatt Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of portions of the record identified on Appendix B are the undersigned and Mr. James G. Keppler, Regional Administrator, Region III. The persons responsible for the denial of the record identified on Appendix C are the undersigned and Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

In light of our response to your initial request, we are taking no further action on your letter dated March 24, 1986, F0IA-86-A-47, in which you appealed NRC's lack of response.
