CLOSURE OF CONFIRMATORY ACTION LETTER Rlll-97-002, CONFIRMATORY ACTION LETTER SUPPLEMENTS Rlll-97-002A AND Rlli-97-002B, AND NRC MANUAL CHAPTER 0350 RESTART ACTION PLAN FOR THE ZION STATION

Dear Mr. Kingsley:

On February 25, April 14, and June 6,1997, the NRC issued Confirmatory Action Letter (CAL) Rlll-97-002, and CAL Supplements Rlll-97-002A and Rlll-97-0028, respectively. The CAL and CAL supplements were issued to formalize your commitments to: 1) take specific actions in response to the February 1997 reactivity event; 2) implement actions to address fundamental performance issues; 3) resolve several specific equipment material condition issues pertinent to a plant restart decision; and 4) inform the NRC of your corrective actions prior to plant restart.

On September 12,1997, the NRC issued the Manual Chapter 0350 Restart Action Plan which defined and formalized the process the NRC intended to use to assess the readiness to restart Zion Station Units 1 and 2. In accordance with 10 CFR 50.82, you certified by letters to the NRC l

the permanent cessation of operations at the Zion Station and the permanent remoial of fuel from both reactors on February 13 and March 9,1998, respectively.

j Based upon the 10 CFR 50.82 certifications, the NRC staff reviewed the issues included in CAL Rlll-97-002, CAL Supplements Rlll-97-002A and Rill-97-0028, and the Restart Action Plan to determine if a need exists for continued use of these regulatory processes for a permanently shut down facility. We considered plant processes and performance assessment with Zion Station permanently shut down and defueled to be considerably different from those at an operating plant. Therefore, continued NRC monitoring of Zion Station performance issues using these existing regulatory processes is unwarranted. We will, however, assess the adequacy of

your revised programs and management activities during our review of your decommissioning D

I plans and inspections conducted under NRC Manual Chapter 2561, " Decommissioning Power Reactor Inspection Program." Any corresponding open issues currentl allegation management system will continue to be addressed through that process.

g/ g in addition, the CAL, CAL supplements, and Restart Action Plan also described several specific technical issues which involved equipment material condition and that could apply to a permanently shut down Zion Station. A final determination of the continued applicability of these technical issues to Zion Station is dependent upon your staff's identification and subsequent NRC staff review of those systems and components that will be relied upon to support a decommissioning status.
