Dear Mr. Kingsley:

The Commission has issued the 'enclosed exemption for the Zion Nuclear Power Station (ZNPS) in response to your application dated April 13,1999, and supplemented by letters dated July 8, July 19, and August 30,1999, in which you requested an exemption from certain l

portions of 10 CFR 50.47(b) and 10 CFR 50.47(c)(2). The exemption was requested to allow  ;

- Commonwealth Edison Company to discontinue offsite emergency planning activities and to '

reduce the scope of onsite emergency planning because of the substantially reduced risk to public health and safety resulting from the permanently shutdown and defueled condition of

- ZNPS. The specific requirements from which exemption is granted are identified in your submittals and the enclosed safety evaluation.

I Also, the staff has completed its review of the ZNPS defueled station emergency plan (DSEP) submitted with your application and finds that the plan provides an appropriate level of emergency preparedness at the ZNPS in its shutdown and defueled condition. The plan provides reasonable assurance that adequate protective measures will be taken in the event of a radiological emergency at the ZNPS. Therefore, the staff concludes that the ZNPS DSEP provides for an acceptable emergency preparedness program and, upon receipt of the enclosed exemption, Commonwealth Edison Company may implement the plan.
