Carolina Power & Light Company (CP & L) in a letter to the Office of Nuclear Reactor Regulation (NRR) dated December 18, 1981, requested that the liarris 3 & 4 operating license reviews be cancelled. In a letter dated January 7,1982, CP & L revised the December 18, 1981 letter to request that NRC review Units 1 & 2 for an operating license.

Under 10 CFR Part 170, it is Commission practice to recover review costs using the procedures of Footnote 3 to 10 CFR 170.21 when the review of the project is conplete. Pursuant to 10 CFR 170.12(b), the review of a project is considered complete "...when a permit or license is issued, or an application for a permit or license is denied, withdrawn, suspended, or action on the application is postponed." We consider the review of the OL applications for Units 3 and 4 to be complete as of December 18, 1981, the date CP & L notified the Connission that Units 3 & 4 should be cancelled. Accordingly, we have determined the actual professional staff hours expended and contractual costs incurred by the major program offices (except NRR) for the review of Units 3 & 4 from January 27, 1978, (the date the construction permits were issued) to December 18, 1981 (the date the application was cancelled). NRR has informed us that all four units were reviewed concurrently, and that there was no seperate review for Units 3 & 4. As a result, all NRR professional staff hours and contractual costs will be billed to Units 1 & 2 upon issuance of the operating licenses. Actual costs of the other offices involved in the review of Units 3 & 4 were $26,625 and $25,142 respectively. Under the Commission's regulations, we limit the charge for review to the lesser of actual cost or the maximum fee allowed under 10 CFR 170.21 (a)A.l.

(operating reactor - custom design - concurrent unit review). For this review, the actual cost is applicable. The balance due for the review of the Harris 3 & 4 operating license applications is $51,767.
